Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Focsy (“the App”), you agree to be bound by these Terms of Service between you and Crowncast Labs (“we”, “us”, “our”). If you do not agree to these terms, do not use the App.

2. Description of Service

Focsy is a focus training application developed and operated by Crowncast Labs for macOS and iOS. It tracks your work patterns, provides awareness-based nudges, and displays focus metrics. Focsy does not block, restrict, or prevent access to any applications or websites.

3. License

Crowncast Labs grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the App.

4. Subscriptions & Billing

Focsy offers subscription plans billed monthly or annually. Payment processing is handled by Paddle.com, our merchant of record. Paddle manages all billing, taxes, refunds, and invoicing on our behalf.

• Free Trial: New users receive a 14-day free trial with full access to all features. No credit card is required to start.
• Recurring Billing: Subscriptions automatically renew at the end of each billing period unless cancelled.
• Cancellation: You may cancel your subscription at any time through your account settings or by contacting support. You will retain access until the end of your current billing period.
• Refunds: We offer a full 30-day refund on all purchases. Refunds are handled directly by Paddle, our merchant of record, in accordance with Paddle’s Refund Policy.

5. Accessibility Permissions

Focsy requires certain macOS permissions to function:

• Accessibility Access: Used to detect which application is currently in the foreground. Focsy does not read, record, or transmit what you type.
• Screen Recording: Used to read window titles for more accurate focus tracking. Focsy does not capture screenshots, record video, or access screen content.
• Notifications: Used to deliver nudges, session reminders, and progress celebrations.

All permissions are optional. You may use Focsy in limited mode without granting all permissions.

6. Privacy

Your use of Focsy is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

7. User Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or infrastructure
• Redistribute or resell access to the App

8. Intellectual Property

The App, including its design, code, graphics, and content, is owned by Crowncast Labs and protected by intellectual property laws. The Focsy name, logo, and Focsy character are trademarks of Crowncast Labs.

9. Limitation of Liability

Focsy is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Modifications

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify you of material changes through the App or email.

11. Termination

We may suspend or terminate your access to the App if you violate these Terms. Upon termination, your license to use the App ends immediately. You may export your data before termination.
